Conditions of Entry

Each shopping centre or premises operated by Haben Management Pty Ltd as trustee for The Haben Retail Management Unit Trust ABN 91 873 552 898 and their affiliates (collectively "Haben" or “Centre Management”, "us," "we" and "our") is referred to in these Conditions of Entry as a “Shopping Centre”.

These Conditions apply to all persons entering or remaining in each Shopping Centre. By entering a Shopping Centre, you agree to comply with these Conditions, our Privacy Policy, Website Terms and Conditions, and Car Park Conditions of Entry.

 

1. Entry and Presence

Each Shopping Centre is private property. Centre Management may refuse entry, direct a person to leave, or remove any person who does not comply with these Conditions. Persons who are intoxicated, disorderly or pose a risk may be refused entry or removed. Failure to leave when directed may constitute trespass under applicable law.

 

2. Behaviour Standards

Visitors must behave lawfully and respectfully. Prohibited conduct includes harassment, intimidation, offensive or antisocial behaviour, disruption, unsafe conduct and failure to wear appropriate clothing.

 

3. Directions

Visitors must comply with all reasonable and lawful directions given by Centre Management, security or emergency services.

 

4. Photography and Filming

Photography for personal use may be permitted in certain areas of our Shopping Centres, subject to any directions given by Centre Management, security or other contractors. Prior permission must be obtained if you wish to film or photograph within the premises for commercial, media or other external use.

Photography and filming are not permitted in back-of-house areas, in or around restrooms, or inside retail tenancies without the relevant permission. We may direct a person to stop filming or photographing if the activity is unsafe, disruptive, inconsistent with these requirements, or otherwise inappropriate in the circumstances.

From time to time, we or our authorised service providers may carry out filming or photography in our Shopping Centres. Where practicable, signage or other notice may be displayed in the relevant area to inform visitors that filming or photography is taking place.

If you enter an area where filming or photography is taking place, your image, likeness, voice or other personal information may be incidentally or directly captured in audio, visual or audio-visual recordings or photographs. By entering an area where filming or photography is taking place, you acknowledge that your image and personal information may be collected.

If you do not wish to be recorded or photographed, you should avoid the area while the filming or photography is taking place where practicable. You may also speak to one of our staff members present to discuss whether any alternative arrangements are available.

You must comply with any directions from Centre Management, security or other contractors.

5. Pets and Animals

Animals are not permitted unless authorised. Assistance animals are permitted in accordance with the Disability Discrimination Act 1992 (Cth).

 

6. Smoking, Vaping and Alcohol

Smoking and vaping are prohibited except in designated areas. Alcohol may only be consumed in licensed areas.

 

7. Vehicles, Car Parks and Trolleys

Use of the car park is subject to separate Car Park Conditions of Entry. Vehicles are parked at the owner’s risk subject to law. Trolleys must not be removed and must be returned to bays.

 

8. Commercial Activity

No selling, soliciting, canvassing or leafleting without prior written approval from Centre Management.

 

9. Liability

To the maximum extent permitted by law, the Shopping Centre is not liable for loss, theft, damage or injury. Nothing excludes rights under the Competition and Consumer Act 2010 (Cth).

 

10. CCTV and Surveillance

CCTV and surveillance systems operate in the Shopping Centre and car park. Information is handled in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

 

11. General

These Conditions are governed by Australian law. Conditions may be updated from time to time.

Updated Conditions will be effective upon publication on our websites. Entry to a centre constitutes acceptance of the revised Conditions.
